22 Jul NEW LAW REQUIRES PROMPT RECORDING OF POWER OF ATTORNEY
If you rely on your agent under your Power of Attorney to handle real estate transactions, you better record your Power of Attorney within 10 days after the instrument related to the real estate transaction (such as a deed, deed of trust, oil, gas or other mineral lease) pursuant to a new law that becomes effective as of September 1, 2015. Although the law previously required Powers of Attorney for real estate transactions to be recorded or else the chain of title of the real property is broken, the new law makes real estate transactions voidable if the Power of Attorney is not recorded on or before the 10th day after the instrument related to the transaction was filed for recording.
