05 Mar HUGH HEFNER’S WIDOW THREATENS HIS FOUNDATION OVER DISTRIBUTION OF EXPLICIT PHOTOS GIVING TOO MUCH EXPOSURE
Crystal Hefner, widow of the famed Playboy tycoon, Hugh Hefner, has threatened the Hugh Hefner Foundation over concerns that over 3,000 thousand lewd private videos and photos of women in Hefner’s “scrapbooks” could be distributed. The explicit photos of countless nude women (including possible images of girls who are underage, according to Crystal), which also included sexual activity, were taken without their consent “behind closed doors”. Crystal is not complaining about photos (including hers) in connection with Playboy Magazine. Crystal did not give consent to her images from the scrapbooks being stored and possibly disseminated and she believes that others did not give consent either.

The Foundation has been rumored to want to digitize the photos. Crystal (through her attorney) has expressed concern over hacking and AI deepfake resulting in irreparable harm to thousands. Hugh Hefner’s son indicated the images should preserve his legacy, and they say that there is no evidence of young girls in the photos. The Foundation’s mission is to support the “First Amendment rights and rational sex and drug policies”. Crystal has requested an investigation by the attorney generals in the states of California (where Hefner lived) and Illinois (where the Foundation is located) as to how the images are being handled and stored to prevent distribution. If there is wrongdoing, civil and criminal actions could be taken – even if it is against a charitable organization. Crystal also wants to know how the scrapbooks came into the possession of the Hefner Foundation. Should it have been an asset of his estate?
This case is an illustration of the need to protect the rights and privacy of those who may have been photographed without their knowledge or getting informed (they could have been intoxicated) consent. The name, image and likeness of each person should not be distributed by a foundation or someone else’s estate without the consent of the individual affected. It is anticipated that the states of Illinois and California will establish storage guidelines to protect those who have not given informed consent of their images.
